Texas has one of the most active construction markets in the United States — Dallas-Fort Worth, Houston, Austin, and San Antonio are consistently among the highest-permit-volume cities in the country. And every commercial permit in Texas requires PE-stamped drawings.

Who Governs Texas PE Stamps?

Texas PE stamps are regulated by the Texas Board of Professional Engineers and Land Surveyors (TBPELS) under the Texas Engineering Practice Act (Occupations Code, Chapter 1001).

The Board also has authority over the “responsible charge” requirement — one of the most important and most misunderstood aspects of Texas PE stamp law.


What Must Appear on a Texas PE Stamp?

Required elements:

  • Licensed PE’s name
  • Texas PE license number
  • State of Texas
  • “REGISTERED PROFESSIONAL ENGINEER” or equivalent
  • Discipline (Civil, Structural, Mechanical, Electrical, etc.)
  • Official Texas circular seal

Physical stamp size: Minimum 1.75 inches in diameter — slightly larger than most other states.


Responsible Charge — Texas’s Strict Standard

The Texas Engineering Practice Act requires that a PE stamp only be applied by an engineer who was in responsible charge of the work being stamped.

Responsible charge means:

  • The PE had direct control and personal supervision of the engineering decisions
  • The PE reviewed the engineering content, not just the formatting
  • The PE exercised independent engineering judgment on the document
  • The PE would be able to explain and defend every engineering decision in the document

What it does NOT mean:

  • A PE cannot stamp drawings prepared entirely by others without involvement
  • A PE cannot stamp a document they’ve never seen before signing it
  • A PE cannot be a “rubber stamp” — signing without genuine review

This is one of the most enforced provisions in Texas engineering law. TBPELS has disciplined PEs for stamp-and-sign arrangements where actual engineering review didn’t occur.


Electronic PE Stamps in Texas

Texas accepts electronic PE seals under Board Rule 137.33.

Requirements for a valid Texas electronic seal:

  • Unique to the individual engineer
  • Protected with digital authentication
  • Must include the engineer’s name, license number, and discipline
  • The signed PDF must not be alterable after signing without invalidating the signature

Texas PE digital seals are accepted by all major Texas permit portals (City of Houston, Dallas Development Services, San Antonio Development Services, Austin Development Services, etc.).


When Is a Texas PE Stamp Required?

Always required:

  • All commercial construction in Texas
  • All commercial building permits (site plan, structural, MEP)
  • Engineering calculations submitted for permit

Residential triggers:

  • Structural modifications to existing homes
  • New home construction (structural drawings)
  • Drainage plans above threshold volumes
  • Retaining walls over 4 feet
  • Some jurisdictions: all new residential construction regardless of scope

City-specific: Houston has some of the most permissive zoning rules in the US but still requires PE-stamped engineering drawings for commercial work. Austin and Dallas have stricter local requirements.

North Carolina PE Stamp (30 vol, $4.76 CPC)

Governed by NCBELS (North Carolina Board of Examiners for Engineers and Surveyors). Active growth market — Charlotte, Raleigh-Durham, and Asheville are high-permit-volume markets.

  • Minimum stamp size: 1.5 inches
  • Electronic seals accepted
  • PE stamp required for all commercial permits
  • Residential structural work typically requires PE when involving load-bearing systems

Colorado PE Stamp (30 vol, $3.85 CPC)

Governed by DORA (Colorado Division of Occupational and Professional Licensing). Denver metro area has significant commercial permit activity.

  • Minimum stamp size: 1.5 inches
  • Electronic seals accepted
  • Colorado-specific: Denver requires PE-stamped LID/BMP plans for commercial stormwater compliance
  • Mountain communities require PE for snow load engineering on all new structures

Arizona PE Stamp (40 vol)

Governed by AZPELB (Arizona State Board of Technical Registration).

  • Minimum stamp size: 1.5 inches
  • Electronic seals accepted
  • Phoenix and Scottsdale commercial permits require PE stamp
  • Structural PE often required for hillside construction in Scottsdale and Fountain Hills
