The Situation

Cape Coral has 400 miles of navigable canals more than any city in the world, including Venice, Italy. The owner wanted to install a 14 × 28 ft in-ground pool on their canal-front lot in Southeast Cape Coral. The property backed onto a freshwater canal, with the seawall approximately 11 feet landward of the rear property line.

Lee County is Florida’s #1 building permit county 8,774 residential permits issued in 2025 alone. Cape Coral building department plan reviewers process high volumes daily. They expect complete first submissions.

The Problem

The contractor measured pool setbacks from the seawall.

On a Cape Coral canal-front lot, the seawall sits landward of the water’s edge. But the property line sits even further landward typically 5 to 15 feet behind the seawall face, depending on the recorded plat.

Cape Coral pool setback rules require 5 feet of clearance from the pool water’s edge to the recorded property line not from the seawall, and not from the water’s edge.

The contractor used the seawall as the reference point. When the site plan was submitted, the building department rejected it. The dimensions shown didn’t match the parcel record.

The contractor contacted us with the correction notice in hand. They had received it on a Tuesday and had 10 business days under F.S. 553.792 to respond.

What We Did

We pulled the recorded plat from the Lee County Property Appraiser database. The property line was documented at 11.3 feet landward of the seawall face.

We redrew the pool site plan using the verified property line as the reference point. Pool water’s edge to rear property line: 5.2 feet just clearing the minimum requirement. All four setbacks labeled from the correct reference. F.S. 515.29 pool barrier compliance documented: barrier line shown enclosing pool area, barrier height labeled “48 inches minimum,” gate swing direction noted outward from pool, latch height labeled “54 inches minimum above grade.” Equipment pad shown with clearance. Impervious surface: 38% of lot area — within Lee County’s 50% limit.

Revised plan delivered 8 hours after receiving the correction notice.

The Result

Resubmitted to Cape Coral Building Department on Day 3 of the 10-day window.

Approved on resubmission. Pool construction started the following week.

The lesson: On a Cape Coral canal-front lot, the property line and the seawall face are never the same point. Measure from the recorded property line. We pull the recorded plat for every Cape Coral order.
