Adding a new driveway or expanding an existing one is one of the most impervious-surface-intensive projects a homeowner can do. In many jurisdictions, driveway changes require a permit — and that permit requires a site plan.

When Does a Driveway Require a Permit?

Most US jurisdictions require a permit for:

  • New driveway installations
  • Widening an existing driveway
  • Adding a second driveway opening
  • Changing driveway material (gravel to concrete or asphalt)
  • Driveway connections to county or state roads (may also require a right-of-way permit)

Some jurisdictions have a minimum width or area threshold below which a permit isn’t needed. Check with your building or public works department.

What a Driveway Permit Site Plan Must Include

Standard elements:

  • Property boundaries with dimensions
  • Existing house and all structures
  • Existing driveway (if any)
  • Proposed driveway extension — location, dimensions, and materials
  • Connection to street — show where the driveway meets the street and any curb cut
  • Impervious surface calculation — this is critical for driveway permits
  • Right-of-way notation — show the public right-of-way strip between the property line and the street
  • Setbacks if required by local zoning
  • North arrow, scale, title block

Impervious Surface — The Critical Element

Driveways are almost entirely impervious surfaces. Before adding or expanding a driveway, calculate whether your total hard surface coverage will stay within the zoning maximum.

Calculate:

  • Existing: house footprint + garage + existing driveway + patios + walks + any other hard surface
  • Add: proposed expanded driveway area
  • Total as a percentage of the lot area
  • Compare to your zoning district’s maximum (typically 50–65% for residential)

If the expansion pushes you over the limit, you may need to use permeable pavers, which count at a reduced rate in many jurisdictions, or reduce the scope of the expansion.

Right-of-Way and Curb Cut

If your driveway connects to a county or municipal road, you may need a separate right-of-way permit in addition to a building permit. This typically involves:

  • Approval from the county or city transportation/public works department
  • Curb cut specifications (width, location, ADA compliance if applicable)

Show the right-of-way strip on your site plan and label it.
